Professional Status
CxCheck is a Professional Engineering Assistant, not a licensed Engineer of Record. All outputs, recommendations and audit results generated by the platform are advisory in nature and must be validated by a qualified, licensed professional before any site implementation or regulatory submission.
Liability Shield
Total aggregate liability under this agreement is strictly capped at the preceding 12 months of subscription fees paid by the subscribing entity.
CxCheck shall not be held liable for consequential, incidental, special, or punitive damages, including but not limited to project delays, revenue loss, or operational downtime - specifically addressing the $14M/month revenue loss threshold common in mission-critical data center infrastructure.
Intervention Authority
Per the 2026 AI Governance Framework, the User retains Full Intervention Authority at all times. All AI-generated logic audits, compliance checks and commissioning recommendations must be human-verified before site implementation. The platform provides decision-support tooling - not autonomous decision-making.
Governing Law & Dispute Resolution
This agreement is governed by the laws of the Republic of the Philippines. Any disputes arising under or in connection with this agreement shall be resolved through binding arbitration administered in Parañaque City, Metro Manila.
